Constitution of Nepal - Fundamental law of the land

The fundamental law of the any country is the constitution of that country. Constitution is at the supreme position and all law must be confined with constitution otherwise that law cannot be regarded as valid law and declared void.

Article 1(1) of the Constitution of Nepal also states that this constitution shall be the fundamental law of the land and any law inconsistent with this constitution shall be void. It means if any law made but that doesn't full fill the constitutional requirements and against the provisions of constitution then such law is voided. Therefore, no law is higher and supreme than Constitution.

Constitution determines the rights, duties and functions of government organs i.e. legislature, executive and judiciary and also of constitutional bodies. Construction determines the structure of government and distribution of political power between them. Everyone officials have to act according to Constitution. If they do anything by going outside the provisions of Constitution then there acts will not be valid. Therefore, Constitution of Nepal is the fundamental law of the country.

Constitution of Nepal is the fundamental law of the land and every citizens of Nepal must obey the constitution and laws of Nepal. Constitution is a political-legal document which determines the political as well as legal structure of a country describing how that country is governed.

Like what type of political power should be there, what type of government should be there, how people of the country is governed and what type of government structure should be there are the things determined by the constitution.

But all these things are depended on the wills of people of country. What type of rules and provisions should be written in the constitution is determined by the will of people. We can say that constitution is the results of general will of people.

Yes, Constitution of Nepal is the document of mutual understanding because the Constitution of Nepal is made by representative of people of Nepal elected for Constituent Assembly for making constitution. The all political parties have contributed and give their views while make constitution. Political parties in democracy is the representatives of people and they conducts their activities according to wills and beliefs of people who voted for them.

Constitution of Nepal is the document of mutual understanding because it is made by representative of people after a long discussion and deliberation. Constitution of Nepal consists the voices of people, wills of people, norms of Nepalese societies and secure rights and duties of people of Nepal for their benefits. Every people obey and respect constitution and bind themselves with the provisions of Constitution of Nepal that's why we can say that Constitution of Nepal is the document of mutual understanding of Nepalese people.
